Column: Don’t Make ‘The Worst Legal Mistake Of Your Life’. Why It’s Important To Hire A Local Lawyer

When a reader suggested for syndicated columnist and lawyer Dennis Beaver to write an article about why it’s a good idea to hire a local lawyer — as opposed to those salesy TV lawyers — Beaver reached out to Chain | Cohn | Stiles managing partner David K. Cohn to explain the importance. Below is a column by Beaver answering the reader’s question, as published in the Santa Maria Times.

“Two of my employees were involved in an auto accident that was not their fault. They were about to hire an out-of-town law firm that advertises heavily on television because the attorney in the commercials is a big fan of the same football team they are!

“I told them that’s not a sound basis to retain a lawyer, and to stay local, as our town has many good attorneys. Also, I had them read your December, 2020 article, “Could Your Lawyer Have Cheated You on Your Bill,” which described illegal charges by a TV-advertising, personal injury law firm hundreds of miles away from where your reader lived.

“But they would not listen me, hired them despite horrible Yelp reviews, and now have large unpaid medical bills! Dennis, an article explaining why it is a good idea to hire a lawyer who actually lives in your town would help a lot of people.”

“Fight for You Rights” TV Commercials

We’ve all seen television ads for personal injury and workers compensation law firms that say things like, “We fight for your rights!” What they do not tell you is that hiring one could be the worst legal mistake of your life.

The California State Bar is investigating the fraudulent billing practices of the law firm in my December 2020 article – and they are one of many law firms I am aware of who illegally charge for expenses that the lawyers never incur.

So, Why Stay Local?

I spoke with Bakersfield attorney David Cohn, in practice over 40 years, and considered one of the most accomplished personal injury trial attorneys in the United States. He outlined the risks in hiring a lawyer based on snazzy television commercials.

“In so many instances, the TV ads make it look like the lawyer is local, but that’s deceiving. Many are personal injury mills with a local phone number, and even a local office address. But drop in and you will never find an attorney. You will almost never meet the lawyer in person, only office staff.

“So, you see their commercial, phone, overcomes an investigator who signs you up, and immediately they send you to their out-of-town doctors just to build up huge, unnecessary medical bills in the hopes of a large settlement which seldom occurs. And, you could be left with unpaid bills. I see this often.” Cohn points out, adding:

“When their dissatisfied clients come to us, we often find medical bills that are 10 times what is normal! Clients have no idea what they have gotten themselves into.”

One of the dirty little secrets of these personal injury mills – who spend millions on television advertising – is something clients are also unaware of: “They do not have your best interest in mind and do not ‘fight’ for top dollar! All they want is a quick settlement.”

The TV ads give the impression that the lawyer you see in the commercial —who you will likely never meet — is handling your case. But Cohn notes:

“In reality, it’s an administrative assistant, not an attorney! They take any accident case and hope for one with significant injuries which they broker to a trial lawyer–for a large referral fee — because the lawyers who run these firms don’t try cases!”

Will Your Lawyer Actually Go Court?

In spite of what we see on television and in the movies, few lawyers go to court. Very few personal injury lawyers have ever tried a case. But, does it really matter? And, if it is true that most personal injury cases settle before trial, should it matter at all where my lawyer is located?

You bet it does!

Cohn explains why it is so critical – even for what may seem to be a ‘simple’ case that you would never expect to wind up in court – to be represented by local counsel who are real trial attorneys – who will try a case.

“Insurance companies know which lawyers will go to court and ‘TV’ lawyers who just settle a case without going the extra mile for the client. This allows the company to settle your case for far less — often thousands of dollars less — than what is fair.”

And if your case has to go to trial?

“You want a local law firm that tries cases, knows and is known by the judges in your community, not someone the TV law firm found because they aren’t able to provide their clients with competent professional service,” Cohn underscores.

And Before You Hire the Attorney …

Cohn lists these five important steps before retaining a lawyer.

(1) Research and find out as much as you can about the attorney.

(2) Is that lawyer local?

(3) Does that lawyer try cases in court?

(4) What is their success rate?

(5) Go to your State Bar’s website to find out of that lawyer has had any disciplinary issues.

Concluding our interview, I asked, “What has given you the greatest satisfaction from your long career in law?”

“It is doing the best I can to make my clients as whole as possible. That’s my job, but, Dennis, as corny as this sounds, it’s really more than a job. It is a calling.”

Chain | Cohn | Stiles resolves several cases involving misconduct at North High School

Chain | Cohn | Stiles law firm has resolved four cases on behalf of students at North High School who were victims of sexual misconduct by an athletic equipment manager at the school.

The cases settled for a total of nearly $2 million.

Kern County Sheriff’s Office had arrested Edwin Rodriguez on suspicion of lewd and lascivious acts with minors 14 to 15 years old, exhibiting harmful matter to a minor, annoying a child under 18 and false imprisonment. He was sentenced to time served after pleading no contest to a charge of committing a lewd or lascivious act with a 14 or 15 year old, and ordered to register as a sex offender for the rest of his life, according to media reports.

Rodriguez resigned from North High in 2018 after a student reported receiving sexually explicit messages from him through social media. A school administrator notified the sheriff’s office, which determined Rodriguez sent inappropriate messages through Snapchat to at least eight juvenile students, and had sexual contact with several of them.

According to the victims, Rodriguez would give students sodas and candy, befriend them on the social media, and send them sexually explicit photos and videos, among other sexual misconduct that took place over several years. One of the women shared that the abuse first occurred when she was a sophomore in high school.

In one instance, Rodriguez sent a photo on Snapchat to two of the girls that showed him wearing shorts and a tank top and grabbing his penis. A number of text messages sent by Rodriguez to the girls told them he thought they were “hot” or commented on various parts of their body he found attractive.

The mother of one of the victims has also spoken out.

“This sick man manipulated my daughter. She and I are very close, but she felt she was doing something wrong and was afraid to tell me about it,” said the mother of one of the victims in a statement. “My hope through this lawsuit is to prevent this from happening in the future, and to protect our students through better accountability and scrutiny of school officials.”

“I think all the markers were out there,” Cohn told KGET-17.

Chain | Cohn | Stiles attorneys and the parents of the victims advise other parents to talk to their children about boundaries with those authority.

“Take this opportunity to have a discussion with your teenager,” Cohn said. “Students should never have one-on-one conversations through social media or text messages with school personnel, coaches, or other adults in authority. And encourage them to speak up if someone in authority contacts them privately or crosses a line.”

 

OTHER MISCONDUCT CASES

Chain | Cohn | Stiles also resolved several lawsuits on behalf of victims of sexual assault by a Kern County Juvenile Corrections officer while they were housed at James G. Bowels Juvenile Hall. Settlements of $200,000, $250,000, and $400,000 were reached with the County of Kern on behalf of the victims, respectively. The final settlement was reached recently after the Ninth Circuit Court of Appeals ruled in favor of the victim, a Chain | Cohn | Stiles plaintiff, who had alleged that in 2015 corrections officer George Anderson made sexual comments to her, groomed her for sexual abuse, propositioned her for sex and watched her shower. The appeals court found that the U.S. District Court for the Eastern District of California erred in its 2016 decision and reversed it.

In another case, a former McFarland High School basketball coach pleaded no contest to contacting a teenager to commit a sex act. Fernando Pruneda faces two years in prison and sex offender registration after pleading no contest to the felony. Chain | Cohn | Stiles, which represents the teenager and family, said the civil matter can proceed now that the criminal case has been resolved. “Fernando Pruneda attempted to sell a position on the varsity basketball team in exchange for sex, and this disgusting and abhorrent conduct deserved to be charged as a felony,” Clark said in media reports. “We congratulate the Kern County District Attorney’s Office for their perseverance in securing this plea deal. This case is an example of how sexual predators groom their young prey, and that high school personnel, if it were paying attention, would have been aware of this conduct.” According to court documents, Pruneda tried to get sexual favors from a junior varsity basketball player. The boy told detectives Pruneda massaged him — as well as other players — below the waist. When the boy resisted or told Pruneda to stop, the coach told him “you won’t get varsity,” according to the documents. The boy also told investigators Pruneda forced him to sleep in the same bed with him during away tournaments. When deputies questioned Pruneda about inappropriate text messages he sent the boy, Pruneda told them he was just joking around. Pruneda coached boys’ basketball for 15 years and helped coach baseball.

What to do in a sexual abuse / assault case

Call for help: Always call the police, a rape hotline, or both following any form of sexual assault or abuse. The sooner you get in touch with someone, the sooner justice can be served.

See a doctor: Seek immediate medical care following a rape or sexual abuse. Hospitals often have specialists trained to help in these types of situations, and they often have someone on staff that can help with stress.

During pandemic, auto crashes are down throughout California, but not in Bakersfield-Kern County

The coronavirus pandemic has affected all aspects of our lives, including driving habits. In fact, traffic volume is down throughout California’s roadways, which has resulted in fewer collisions and arrests for driving under the influence across the state.

Unfortunately, the same can’t be said for Bakersfield and Kern County.

While California saw an 88% reduction in the number of people killed in crashes and a 62% decrease in the number of people injured in crashes from March 19 to April 30 this year versus last year, the Bakersfield area saw a 33% increase in fatal crashes from 8 in 2019 to 12 in 2020 during this same time period, according to data from the California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS).

California also saw a 75% decrease in the number of crashes, and the total number of truck-involved collisions also saw a 60% drop, with fatal truck-involved crashes down 88%, according to CHP. The number of DUI arrests made by officers has decreased during March and April in California, from 7,224 in 2019 to 4,223 in 2020; a decrease of 42%.

Even more, the open roads have left some drivers feeling the need for speed. CHP officers issued 2,738 citations for speeding in excess of 100 miles per hour between March 19 and April 30, which is an increase of 46% from last year. Locally, the CHP’s Central Division, which covers the Central Valley, saw a 61% increase in speeding over 100 mph tickets during the same time period.​

According to Verra Mobility, a photo enforcement company with 4,000 camera locations in the United States, speed violations were up 16%, and the number of vehicles going at least 20 miles per hour over the local limit increased 40% in April compared with the same month last year.

The surge in speeding and reckless behavior on our roadways has led to increased patrolling on local highways. A first offense for a 100 mph citation could lead to a $1,000 fine, loss of license for 30 days, or worse — speeding endangers lives of everyone on the road.

“During this time, taking care of yourself and one another goes beyond wearing a mask and physical distancing. We all have a responsibility care for each other on our roadways, too,” said David Cohn, managing partner and personal injury attorney at Chain | Cohn | Stiles. “Please Slow down, take your time, pay attention while driving, and drive sober.”

Across the country too, U.S. highways have gotten emptier and they have also been more deadly, data from the National Safety Council shows. The fatality rate per mile driven went up by 14% compared with March 2019. The number of miles driven dropped 18.6% in March compared with the same month last year, but the death rate per 100 million vehicle miles driven was 1.22 in March, up from 1.07 in March 2019.

Chain | Cohn | Stiles reminds drivers to please slow down, never drive while under the influence, and always wear seat belts. And if you are involved in a car accident, follow these three steps:

1) Obtain the name, address, insurance information, vehicle identification number (VIN) and driver’s license number of any and all persons involved in the accident, as well as the names, addresses, and telephone numbers of all witnesses.

2) Make sure that a report is filed with the police, sheriff, or highway patrol, but do not talk to anyone else, especially insurance adjusters, about the accident or sign anything without first consulting an attorney.

3) Seek medical attention immediately and explain to your physician or surgeon all of the symptoms and complaints you have been feeling since the accident occurred.

Each year, Kern County nominates, votes on, and chooses the best restaurants, shops, services and people in our community through The Bakersfield Californian‘s “Best of Kern County” Readers’ Choice Poll. This year is no different.

Chain | Cohn | Stiles has been selected into the “Best Law Firm” category as a “favorite” in the 2020 “Best of Kern County” poll, with results announced in the May issue of Bakersfield Life Magazine.⁣ ⁣

How a legendary local lawyer helped a young man in need, who then paid him back 60 years later

Over its 85-year history, Chain | Cohn | Stiles has seen and heard countless inspirational stories from the people of Kern County, who visit the law office for assistance during what is typically their time of greatest need.

The story of Kenneth Cannon is no different. Back in 2015, 87-year-old Cannon visited the law office and shared his story of how Morris Chain helped him 60 years before:

At that time, Cannon, of Wasco, was in his prime. But he ended up in a fight with a neighbor that landed him in court facing a lawsuit.

“I punched him,” Cannon said. “It was the wrong thing to do, but that’s what happened.”

His neighbor had broken a bone and was suing him for $10,000. So, he went to the legendary local lawyer Morris Chain to defend him. Chain heard him out and told Cannon he would have done the same thing to his neighbor.

In 1955, Morris Chain had been practicing law in Bakersfield for more than 20 years already, and he had formed a formidable team around him including secretary Helen Banducci, and lawyers Albert Noriega and Milton Younger. Investigator Leonard Winters also worked directly with Chain for more than three decades. In fact, by the 1960s, Chain had achieved a state-wide reputation for being flamboyant in the courtroom while being dramatic, witty, entertaining and exciting to watch. But his performance always was firmly anchored to the logic of the law. He would be called “the Rembrandt of the courtroom,” and even served as a lawyer in the infamous Spade Cooley murder trial.

Back to Cannon, Chain had ultimately managed to get his fine reduced from $10,000 to $1,500, still a hefty fine back in those days. Morris’ fee was $100, but Cannon was working in the potato fields and so he promised to pay Chain over time. Chain told him: “Once you get on your feet, you pay me.”

Fast forward 60 years, Kenneth — an Air Force veteran who served in the Korean War — noticed in the newspaper that the law firm moved offices from the Bank of America building to Chester Avenue and 18th. He walked into the lobby with a new $100 bill he took out from the bank stuffed inside of a small yellow envelope, and asked for David Cohn, managing partner and attorney at Chain | Cohn | Stiles.

“I know Morris died in the 1970s, but since you still have Chain’s name at your firm, I felt I should give the money to you.” Cannon told Cohn. “It’s been on my mind this whole time. I had quite a guilty conscience about it all. I was obligated to pay back my debt. I should have done it long ago.”

Cohn accepted the $100 bill on behalf of Chain. He later sent Cannon a photo of Morris Chain and a $100 check as a token of appreciation for sharing his story. Cannon later wrote back that he had framed the check and hung it inside of his home.

Local columnist Richard Beene made a mention of this tale in his blog, and called it “a sweet story of honesty, forgiveness and faith that will send you into the weekend with a smile.”
